Dear Interested Parties,
On September 10, 2026, the State Licensing Authority filed an adoption order for new and revised permanent rules. The adopted permanent rules will take effect on November 1, 2026. For more information about the 2026 rulemaking session, please visit the Division’s 2026 rulemaking webpage.
The final adopted rules incorporate changes informed by feedback received at the Marijuana Enforcement Division’s stakeholder meetings, permanent rulemaking hearing, and written comments submitted to the Division. The Division extends its appreciation to stakeholders for their participation and valuable contributions in this year’s rulemaking.
The Division is prioritizing the development of resources to assist the industry’s compliance with new and revised rules. This will include the issuance of Industry Bulletin(s) and/or Compliance Tip(s) prior to new rules taking effect on November 1, 2026. Licensees should also consider measures they can proactively begin employing to prepare for compliance with these rule changes. Until these new adopted rules take effect, the current Colorado Marijuana Rules continue to apply to Licensees.
Finally, as announced in the rulemaking hearing, the Division will engage stakeholders in separate forums to facilitate ongoing discussions on certain subjects proposed by stakeholders that were not included in the adopted rules.
