Supreme Court Justice Ketanji Brown Jackson warned that the Court’s decision to revive key parts of President Donald Trump’s election executive order could undermine confidence in the electoral process ahead of the 2026 midterms.

In a sharply worded dissent, Jackson argued the ruling risks “jeopardizing” the public’s interest in a “fair and orderly election cycle.”
Jackson accused the Court’s conservative majority of allowing the Trump administration to move forward with election-related initiatives without resolving fundamental questions about whether the president has the legal authority to impose them.
She argued the decision could create uncertainty in the months before the midterm elections, potentially forcing states to make changes to voting procedures while litigation over the executive order remains unresolved.
The White House celebrates
The White House celebrated the ruling, which lifted a lower court bar on the executive order, as a “major win” for election security.
“These are commonsense measures that protect the security of mail-in ballots and ensure only Americans are electing American leaders,” spokesperson Lauren Bis told Newsweek in a statement. “This administration will continue to lawfully enact the agenda President Trump was elected on – which includes the safety and security of our elections.”
The legal challenge was brought by a coalition of 23 Democratic-led states — including California, New York, Illinois, Pennsylvania and Michigan — and the District of Columbia.
A ‘painful setback’
New York Attorney General Letitia James called the decision a “painful setback.”
“The right to vote is sacred and no administration should be able to put that right in jeopardy,” James said. “We’re exploring our legal options.”
Santiago Mayer, executive director at Voters of Tomorrow, also condemned the ruling and accused Trump of seeking to suppress young voters.
“Since the 2024 election, millions of young people have turned 18 and are now eligible to vote. That is a terrifying reality for Donald Trump and why he’s doing everything he can to silence the will of voters,” Mayer said. “Today’s Supreme Court ruling is horrifying, undemocratic and a stark reminder of what’s at stake in this moment. If we allow this authoritarian regime to continue unchecked, more of our rights will be stripped away. Democracy is fragile.”
