Cannabis and Driving Licence Law: Summary Highlights New Rules, MPU Hurdles and Patient Privilege

2026-08-04 | According to a current overview of the legal situation since 2024, raising the THC limit to 3.5 ng/ml in blood serum is intended to ease the situation for first-time offenders, as an MPU is only ordered in cases of repeat offences or additional factors such as very high THC levels, according to Georg Wurth (DHV) and Manuel Cran of MPU-World in a YouTube  video.

Patients using medical cannabis benefit from the patient privilege when cannabis is used as prescribed and fitness to drive can be demonstrated, but in some cases face strict documentation requirements from driver’s licence authorities. Despite the introduction of criteria for “controlled use” from 2026, assessments remain complex due to inconsistent administrative practices and strict interpretations in cases of combined substance use.
