The Department of Cannabis Control (DCC) is providing notice to the public of its intent to readopt the emergency regulations that allow licensees authorized to engage in retail activities for both adult-use (A-) and medicinal-use (M-) under a single license to modify their license to an A-license and a new separate M-license. The emergency regulations were
initially adopted by DCC and approved by the Office of Administrative Law (OAL) on June 5, 2026, in response to the federal government’s
rescheduling of medicinal cannabis from Schedule I to Schedule III. The proposed readoption action seeks to keep the emergency regulations in effect while DCC works toward making the regulations permanent through the regular rulemaking process. DCC recently provided
notice of its intent to permanently adopt the emergency regulations on October 30, 2026, and is currently accepting public comment on the proposed permanent adoption through December 14, 2026.
The proposed rulemaking documents for readoption are available on DCC-2026-03-E: Modifications to A and M Designation rulemaking page on DCC’s website.
Any proposed regulatory actions by DCC should not be considered conclusive advisement to businesses on whether pursuing federal registration is the right decision or that license modification is necessary to obtain registration approval. Licensees should continue consulting with their legal counsel and business advisors for guidance related to federal registration or operational changes. More information about federal rescheduling can be found by visiting our Federal rescheduling resources webpage or by emailing DCC at info@cannabis.ca.gov.
