Austrian Court Ruling: Setback for Tobacco Monopoly on Hemp Flowers
2026-05-05 | Austria’s Federal Finance Court (BFG) has temporarily halted the classification of hemp flowers under the state tobacco monopoly, according to newsweed. The seizure of CBD products from vending machines operated by RETO Concept GmbH was deemed unlawful. Customs authorities had justified the confiscation in March 2025 under the Tobacco Monopoly Act, which the court rejected as insufficient.
According to the industry association ÖCB, the BFG clarified that hemp flowers may not automatically be treated like tobacco products. Association president Klaus Hübner described the ruling as a victory for legal certainty. The authorities’ attempt to systematically subject hemp products to the monopoly had therefore failed.
However, the political situation remains tense: a reform proposal envisions that low-THC cannabis products may only be sold through licensed tobacconists after a transition period ending in late 2028. The ÖCB has already announced plans to challenge these future restrictions before the Constitutional Court. For the time being, the ruling significantly strengthens the position of independent retailers.
